Mediation isn’t ever binding. It’s just a forum for the parties to work out a settlement. If you settle, the settlement agreement is a contract that is binding on both parties. Arbitration is binding, but BBB doesn’t do that.

Can I ask how much lawyer fees you guys are paying or being quoted? It seems like even if you get $1,000-2,000 more for the buy back going through an attorney, your attorney’s fee would offset that. You’d have to really win big and get the court to award attorney’s fee, which could take a year or so.

You must not know how lawyers work. IF you are awarded attorney’s fee, it is to reimburse you for the money that you’ve paid your lawyer. If you lose, then you’re out of that money. That’s why I’m surprised that people would even hire a lawyer over $1,000-2,000.

My lawyer was a lemon law specialist. The 5.4L had a known issue within Ford and he ultimately billed Ford. I didn’t pay him a dime. Ford can either pay the attorney up front, do right by the customer or risk going to court. The OEMs know when they are wrong and usually settle out.

I can see Ford using a third party to buy the truck back minus $15k+ fees and turning around and selling it used somewhere else. Almost zero out of pocket, might even make money for the selling dealer.

We bought a new Honda Pioneer 1000 sxs ATV in its first year of production and found that the passenger seat became very hot. My wife had to sit on a sweatshirt or towel in order to get back to the truck. We repeatedly took it back to the dealer. They eventually contacted Honda about it and was told it was a known issue but no fix was available. We tried adding insulation under the seat with no improvement. Fortunately, my wife is a paralegal who works for a lemon law lawyer. We got Honda to buy back the ATV, taxes, licensing, insurance premiums, the trailer, gas we had used in the year that we had it and lawyer fees. In the end, we had a refund of every dime associated with the purchase and ownership. Our lawyer felt the settlement was better than he had expected and thought they were trying to avoid a class action lawsuit.

In your case, Ford has well paid lawyers and they aren't going to pay a dime more than they have too. I would recommend getting a lawyer to look out for your best interest. This "fair use" crap is BS. You should get back every dime you paid for it.
