I feel terrible about your situation - and was in a similarly ****** situation with a transport company about 2 months ago.

My situation was a bit different - the transport company drove my truck through a tree and then claimed no responsibility. As you've seen, many here say you should go after the dealer. For me, this wasn't useful - this would have required a ton of time, energy, and lawyers to hold them accountable. The same energy that I could have applied going after the party that messed up my truck.

What helped me was to pull in my insurance company and my bank. Both have a vested interest in the asset, so you should consider them 'on your team'. I then looked up the transport carrier's insurance company on our FMCSA site. CAD may have something similar.

Within a day of calling 'my team' & calling their insurance company, the tone at the transport company totally changed. They were bending over backwards to fix things for me.

Speaking with the bank is a very good point. The collateral for your loan is the vehicle. No vehicle, they have nothing to reposes if you don't make payments for whatever reason.

Also concern speaking to the media about this, or threatening to. The dealership certainly does not want this story going public.

I still surprised that this sort of deal is even legal. By that I mean I don't know how you can be expected to turn in the trade in (and they can sell it) and you're responsible for the new truck before delivery when you did not setup the delivery.

This may true or it may be hyperbole, but consider this: If you ever do have to shoot someone someday, this post is out in public for a prosecutor to find. You're giving him an opportunity to say that you weren't panicked and in fear for your life because you've been thinking about it since November of 2021 and looking for an excuse. That could make the difference between freedom and jail if it isn't a clear-cut situation. Or you could lose everything in a civil case because of it. Thoughts like this are best kept to oneself.

Spot on. It's also why people who don't like guns don't like guns. They think we all just get angry and get violent. I've had these debates with people and always have to explain that that's not the case when you actually carry a gun. Please don't provide evidence to that idea, and if that's your attitude about the responsibility of gun ownership, please sell off your guns.

Back to the topic at hand. Since no one has mentioned this...ABSOLUTELY DO NOT TAKE ANY OFFER FROM THE DEALER, even a loaner at this point, and don't demand anything that is less than your truck. I don't know about Canada, but in some cases taking an offer from a party limits your right to sue them. Talk to a lawyer FIRST. Then call your bank. It is their asset until you've paid in full, and they will make sure to keep it. They usually also have better lawyers on hand than most of us could afford.

Update:

shipper told the dealer it would be delivered this morning, and it hasn’t.

shipper has blocked communication to dealer.

dealer says he is creating fake phone numbers to harass the shipper.

shipper promised delivery tonight.

dealer is going to the shipper’s head office tomorrow with the police if they truck isn’t here tonight.

dealer has stated he will figure out something fair for me once I have the truck.

If the truck isn’t in my possession tomorrow I’m asking the dealer for an email stating they were unsuccessful in getting it from the shipper and police are contacted. I’ll be using this email and going to a lawyer first thing. Bank is now aware of the situation, they want me to call tomorrow.

If the truck shows up, you better check it over really well, something is up for them to of had it this long, if you are not mechanically inclined or have OCD, find somebody who is and have them nearby to help you inspect the truck. Good luck.
